These Terms & Conditions govern your use of Klartext Housing, an apartment-hunting alert service for Berlin operated by Klartexthousing ("we", "us", the "Seller"). By creating an account or using the service, you enter into a contract with Klartexthousing and agree to these terms.
Klartext Housing monitors Berlin housing portals for new rental listings, matches them against the search criteria you configure (budget, size, rooms, districts, and requirements such as Anmeldung, pets, or WBS), and notifies you of matching apartments. We also provide tools to manage your application documents and track your apartment pipeline.
We do not act as a real-estate agent and do not guarantee that any apartment will be offered to you. Landlords and portals decide independently whom they invite or select.
By continuing to use the service you accept these terms. You must be at least 18 years old and, if you use the service on behalf of an organisation, you must have authority to bind that organisation.
You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account.
You must not misuse the service. In particular, you must not:
We retain all ownership of the service and its intellectual property, including the software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. Content you upload (such as application documents) remains yours; you grant us a limited licence to host and process it solely to provide the service.
Paid plans are billed as a monthly subscription. Payment, billing, tax, cancellation, and refund mechanics are handled according to Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms).
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
We work hard to keep the service fast and reliable, but we do not guarantee uninterrupted or error-free performance. Listing availability depends on third-party portals outside our control.
We may suspend or terminate your access in cases of material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time; when access ends, your personal data is handled as described in our Privacy Notice.
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.
These terms are governed by the laws of Germany. The courts of Berlin, Germany have jurisdiction, unless mandatory consumer-protection law provides otherwise.
